General Terms and Conditions

Scope   

 These General Terms and Conditions (GTC) apply to all orders placed by consumers and entrepreneurs through our online shop. 

A consumer is any person who concludes a legal transaction for purposes that can predominantly be attributed neither to their commercial nor their independent professional activity. An entrepreneur is a natural or legal person or a legal partnership that, when concluding a legal transaction, acts in the exercise of its commercial or independent professional activity. 

These GTC also apply to future business relationships with other entrepreneurs without the need for further reference. If the entrepreneur uses conflicting or supplementary general terms and conditions, their validity is hereby contradicted; they only become part of the contract if we have expressly agreed to them. 

Seller, Inclusion of General Terms and Conditions by Reference 

(1) The seller and contracting party for the goods offered in the online shop www.rugtales.com is IPEK Warenhandelsgesellschaft mbH, located at Borsteler Chaussee 85, House 21, 22453 Hamburg, Germany (hereinafter referred to as the "Seller"). 

(2) These General Terms and Conditions are an integral part of any contractual agreement between the Seller and the respective customer. The Seller hereby objects to any conditions set by the customer that conflict with these General Terms and Conditions. 

Product Offer and Conclusion of Contract 

(1) The Seller offers the items presented in the online shop for purchase. The colors of the items displayed on the website may vary slightly depending on the customer's internet browser and monitor settings; these deviations are technically unavoidable. a. Additionally, the Seller offers unique and handcrafted products. Irregularities in color or asymmetrical parts are product-related and cannot be claimed as defects. 

(2) The selection of goods, the conclusion of the contract, and the execution of the contract are in English. 

(3) The Seller delivers the goods to destinations within the EU. 

(4) The customer selects the desired goods by clicking the "ADD TO CART" button and continues shopping or clicks the "CHECKOUT" button to finalize the selection of goods. 

(5) Within the shopping cart, the customer can alternatively click the "Checkout with PayPal" button. This redirects the customer to the website of the PayPal S.a.r.l. payment service, where they can log into their account. After logging in, the customer is redirected to the provider's website, which automatically uses the customer's name and address from the customer's PayPal account for the order. 

(6) The order is finally transmitted to the Seller by clicking the "COMPLETE ORDER" button. Until the order is transmitted to the Seller, the customer can review, change, or cancel the data entered during the order at any time. 

(7) The customer may select products from the Seller's assortment, place them in a so-called shopping cart, and submit a binding request to purchase the goods in the shopping cart by clicking the "order with obligation to pay" button. The Seller then sends the customer an automatic acknowledgment of receipt by email, listing the customer's order, which the customer can print out using the "Print" function. The automatic acknowledgment of receipt merely documents that the customer's order has been received by the Seller and does not constitute acceptance of the application. The contract is only concluded by the Seller's submission of the declaration of acceptance, which is sent with a separate email (order confirmation). 

Shipping, Delivery Times 

(1) The Seller delivers the goods within the time specified in the item description after receipt of payment. 

(2) For shipping within Germany, a delivery time of 3-5 working days is calculated. 

(3) For deliveries abroad, an additional period of 7-18 working days, depending on the destination, is added to the respective domestic delivery time. Shipping and returns to Austria, Switzerland, and Germany are free of charge. Prices for shipping to all other European countries are listed on the "Shipping & Return" page. 

(4) If the customer's order includes more than one product, all products will be delivered in a single shipment; the longest specified delivery time for each of the products included applies to this shipment. If the customer wishes for a product to be delivered separately in a shorter time, they can place a separate order for that product. 

(5) If delivery cannot be made because the customer has provided an incorrect or incomplete delivery address, a new delivery attempt will only be made if the customer agrees to bear the costs of reshipping the goods. The return costs correspond to the shipping costs agreed upon at the time of contract conclusion. 

Right of Withdrawal for Consumers 

(1) A customer purchasing as a consumer is entitled to a right of withdrawal according to the legal requirements. A consumer is any natural person who enters into a legal transaction for purposes that cannot be attributed predominantly to their commercial or independent professional activity. 

(2) The right of withdrawal does not apply to contracts for the delivery of goods that are not prefabricated and for the production of which an individual selection or determination by the consumer is decisive, as well as contracts for the delivery of goods that are clearly tailored to the personal needs of the customer. 

(3) The Seller grants a 14-day withdrawal period to a consumer with a permanent residence outside Germany, even in cases where the national law applicable to the consumer provides for a shorter period. 

(4) The Seller bears the costs of returning the goods. 

(5) The Seller enables any consumer with a permanent residence outside Germany to submit an informal declaration of withdrawal even in cases where the national law applicable to the consumer imposes stricter requirements on the form. 

(6) The conditions and legal consequences of the German regulations on the consumer's right of withdrawal apply to consumers with a permanent residence outside the European Union, even in cases where the local law does not provide for a right of withdrawal. Warranty, Defects Liability All warranty claims (defects liability) of the customer are based on the statutory provisions. Final Provisions 

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). However, German law does not apply to transactions with consumers who have their habitual residence abroad, insofar as the national law applicable to these consumers provides for provisions that cannot be derogated from to the detriment of consumers. 

(2) If the customer is a merchant, a legal entity under public law, or a special fund under public law, the parties to the purchase contract agree on the exclusive jurisdiction of the courts at the Seller's registered office in Berlin (Germany) and the Seller's registered office as the place of performance of its contractual obligations. 

(3) Should individual provisions of these General Terms and Conditions be or become ineffective or unenforceable, this shall not affect the validity of the remaining provisions.
